Terms of use

Findbaya is a lead capture and follow-up tool operated by The Catalyst Consulting Firm Ltd ("Findbaya", "we", "us"). By creating an account, or by using a business's Findbaya page, you agree to these terms. If you do not agree, please do not use Findbaya.

What Findbaya is, and is not

Findbaya gives a business a page where customers can send an enquiry, and a place for the business to manage and follow up those enquiries. Findbaya is not a marketplace, a seller, a payment provider or an escrow service. We do not sell, deliver or guarantee any product or service listed on a business's page, and we are not a party to any sale or agreement between a business and a customer.

Who can use it

  • You must be 18 or older to create an account.
  • You must give accurate information and keep your password private. You are responsible for activity on your account.
  • If you register on behalf of a company, you confirm you are allowed to bind it to these terms.
  • If we learn that an account belongs to someone under 18, we may close it and delete its data.

Your buyer list and your messages

  • Findbaya does not supply you with other businesses' contact details. The buyers in your pipeline are ones you add or import yourself, or who contact you through your page. You are the one who decides to hold and use their details.
  • You promise you have a lawful basis to hold and use any contact details you add or import, and that you got them fairly, for example from the person, their public business listing, or a genuine business relationship.
  • Findbaya never sends messages for you. You review and approve each message, then send it yourself. You alone are responsible for following the law on direct marketing and data protection in the countries you contact, including honouring "stop" requests.
  • Do not add or import details of children, or details you obtained unlawfully, and do not use Findbaya to harass or spam anyone.

Businesses: your responsibilities

  • You alone are responsible for what you advertise: your goods, services, prices, delivery, refunds, quality and claims, and for honouring what you promise customers.
  • Everything on your page must be true. This includes testimonials, customer counts and delivery promises. Do not post fake reviews or use another person's name, brand or photos without permission.
  • You must not use Findbaya to run scams or advance-fee fraud, to sell illegal, counterfeit or dangerous goods or services, to impersonate others, or to harass or mislead customers.
  • You must follow Nigerian law, including consumer protection and data protection law. You decide how the customer details you receive are used, so you must use them lawfully, only for responding to that customer's enquiry, and not send unwanted marketing messages.
  • You must not collect personal information from children through your page.
  • You agree to compensate Findbaya for any loss, claim or cost that arises from your trading, your content, or your breach of these terms.

Customers

Findbaya does not check, endorse or vouch for the businesses on its pages or in its directory. Before you pay or share sensitive details, check that the business is genuine, ask for proof where you can, and avoid paying in full before you receive your order. Any agreement is between you and the business. If you think a page is a scam or misleading, use the "Report this page" link at the bottom of that page. If you have been defrauded, also report it to the police or the Federal Competition and Consumer Protection Commission.

Reports, suspension and removal

We may review reports and may remove content, take a page offline, or suspend or close an account at any time, with or without notice, if we think these terms have been broken or a page may harm others. We may share information with the police or regulators where the law requires it or where we believe it is needed to prevent fraud.

Our responsibility

We work to keep Findbaya running, but it is provided "as is". We do not promise that it will always be available or free from errors, or that it will produce any number of leads or sales. To the extent the law allows, Findbaya is not responsible for losses that come from a business's or customer's dealings with each other, or for indirect losses such as lost profit. Nothing in these terms limits liability that cannot lawfully be limited.

  • Findbaya is a software tool. It does not introduce, vouch for, guarantee or take part in any deal between members, buyers, suppliers or customers. It does not give legal, tax, financial, import or export advice. Check customs, licensing and payment rules yourself before trading across borders.
  • Findbaya does not verify the buyers in your pipeline or the details you enter. A buyer in your pipeline is only a prospect. It does not mean the business wants to buy, can pay, or is genuine.
  • Never pay in advance, share bank details, or release goods to someone you have not checked yourself. Findbaya does not hold money and cannot recover money lost in a deal.
  • To the extent the law allows, our total liability to you for any claim connected to Findbaya is limited to the amount you paid us in the three months before the claim arose, or ₦50,000 if you paid nothing.
  • You agree to use Findbaya at your own risk, and you agree not to bring a claim against Findbaya, The Catalyst Consulting Firm Ltd, or its directors and staff for the acts of other members or third parties.

Disputes between members

If you have a problem with another member, deal with them directly and report fraud to the police or the Federal Competition and Consumer Protection Commission (in Ghana, the relevant police or consumer authority). You can report a page or a business to us and we may act on it, but we are not obliged to settle, judge or pay for any dispute between members. If you want to make a claim against Findbaya, you must first tell us in writing what happened and give us 30 days to put it right before you start any legal action.

Payments

When paid plans are switched on, plan prices will be shown in naira before you pay and card payments are handled by Paystack. Customers never pay Findbaya for a business's products through Findbaya.

Your content

You keep ownership of the content you add. You give us permission to store and display it so that your page, the directory and Find buyers can work. You promise that you have the right to share it and that it does not break anyone's rights or the law. If someone complains that your content is false, infringing or harmful, we may remove it without notice.

Leaving Findbaya and closing your account

  • You can leave at any time. Log in, open My page, scroll to Close my account and confirm. We delete your account, your page, your leads, your pipeline and your message history straight away. Download your leads first if you want to keep them, because we cannot restore them afterwards.
  • If you cannot log in, contact us through the WhatsApp button on our homepage and we will close the account and delete your data within 30 days.
  • We may keep limited records that the law requires, or that we need to prevent fraud and handle disputes, such as reports made about a page. Backups are cleared in the ordinary course.
  • When paid plans are switched on, you can cancel at any time and the plan ends when the period you have paid for ends. Fees already paid are not refunded unless the law requires it.
  • Customers who want to stop being contacted should tell the business that contacted them. Businesses must honour that request.

Changes and governing law

We may update these terms and will change the date above when we do. Continuing to use Findbaya after a change means you accept it. These terms are governed by the laws of the Federal Republic of Nigeria.
